Fluff Terms of Use

Welcome to Fluff. These terms explain the agreement between you and us when you use the Fluff app. We’ve kept them as short and plain as we can. Please read them, along with our Privacy Policy, before you start.

By downloading or using Fluff, you agree to these terms. If you don’t agree, please don’t use the app.

Who we are

Fluff is provided by Blank Page Digital Ltd (“we”, “us”), a company registered in England & Wales (company number 17292806), registered office: Office 10033, 321-323 High Road, Chadwell Heath, Essex, RM6 6AX, United Kingdom. You can reach us at hello@blankpagedigital.app.

A gentle but important note about your wellbeing

Fluff offers guided meditations and relaxation audio for general wellbeing. Please keep in mind:

• Fluff is not medical or psychological treatment. It isn’t a substitute for advice, diagnosis or treatment from a doctor, therapist or other qualified professional.
• If you have a physical or mental health condition, or you’re pregnant, please talk to a healthcare professional before starting a new practice, and stop any exercise that feels uncomfortable.
• Never listen while driving, cycling, operating machinery or doing anything else that needs your full attention. Some sessions are designed to make you relaxed or sleepy.
• If you’re struggling or in crisis, please reach out for help straight away. In the UK, call 999 in an emergency, NHS 111 for urgent advice, or Samaritans on 116 123 (free, 24 hours a day). Outside the UK, please contact your local emergency services.

Who can use Fluff

You need to be at least 13 years old to use Fluff. If you’re under 18, please check with a parent or guardian before subscribing, as they may need to agree to the purchase.

Your licence to use Fluff

We give you a personal, non-exclusive, non-transferable licence to use Fluff on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the app store you downloaded it from.

If you downloaded Fluff from the Apple App Store, your use is also governed by Apple’s Licensed Application End User Licence Agreement (the “Standard EULA”). These terms add to the Standard EULA. If there’s a conflict between the two, the Standard EULA applies to the extent required. You also acknowledge that:

• these terms are between you and Blank Page Digital Ltd, not Apple, and we (not Apple) are responsible for Fluff and its content;
• Apple has no obligation to provide maintenance or support for Fluff;
• if Fluff fails to meet any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for Fluff;
• Apple is not responsible for handling any claims relating to Fluff, including product liability claims, claims that it fails to meet legal or regulatory requirements, or consumer protection claims;
• if anyone claims that Fluff infringes their intellectual property rights, we (not Apple) are responsible for dealing with that claim;
• you confirm that you’re not located in a country subject to a US government embargo, and that you’re not on any US government list of prohibited or restricted parties; and
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded Fluff from Google Play, the Google Play Terms of Service also apply to your use of the store.

Your account

To use Fluff’s account features, you sign in with Apple or Google. Please keep access to that sign-in secure, as anything done through your account is treated as done by you. Let us know straight away if you think someone else has used your account.

You can delete your account at any time in the app (Profile → Delete account) or by emailing us. See our Account Deletion page for details.

Subscriptions

Some of Fluff, including the full meditation library and offline downloads, needs a subscription. We offer monthly and yearly plans. The current price is shown in the app and in the App Store or Google Play before you confirm, and may vary by country.

Subscriptions are sold and billed by Apple or Google, not by us, under their terms. In particular:

• Auto-renewal: your subscription renews automatically at the end of each period, and you’ll be charged by Apple or Google, unless you cancel. On the App Store, auto-renewal must be turned off at least 24 hours before the end of the current period. On Google Play, you can cancel at any time before the next renewal date.
• Cancelling: you can cancel in your device’s subscription settings:
  • iPhone: Settings → tap your name → Subscriptions → Fluff
  • Android: Google Play → profile icon → Payments & subscriptions → Subscriptions → Fluff

  When you cancel, you keep access until the end of the period you’ve already paid for. Deleting the app or your Fluff account does not cancel your subscription.

• Free trials: if we offer a free trial, its length and the price that follows will be shown before you start it. Unless you cancel before the trial ends (on the App Store, at least 24 hours before), it will turn into a paid subscription automatically.
• Price changes: if the price of your plan changes, Apple or Google will let you know in advance, and where required ask for your agreement, before the new price applies.
• Refunds: because payments are made to Apple or Google, refund requests are handled by them under their own policies. For Apple, visit reportaproblem.apple.com. For Google Play, see Google Play’s refund help. We’re always happy to help if you email us.
• Your right to cancel: when you subscribe, you agree that we can start providing digital content straight away. This means the usual 14-day right to change your mind under UK consumer law may no longer apply once access begins. This doesn’t affect your other legal rights, including if something is faulty.
• Restoring purchases: if you change device or reinstall the app, use Restore purchases in the Profile screen to get your subscription back.

Using Fluff kindly

Please don’t:

• copy, share, sell, rent, broadcast or publicly perform Fluff’s audio or content, or make it available to others outside the app;
• try to get around subscription controls, or download, extract or record content other than through the app’s own download feature;
• reverse engineer, decompile or modify the app, except where the law allows you to;
• interfere with or disrupt Fluff or the services it relies on, or try to access other people’s accounts or our systems without permission;
• use Fluff for anything unlawful or harmful.

If you break these terms in a serious way, we may suspend or close your account. We’ll tell you why where we reasonably can.

Our content

All meditations, audio recordings, scripts, text, artwork, designs, the Fluff name and logo, and the app itself are owned by or licensed to Blank Page Digital Ltd and are protected by copyright and other intellectual property laws. Apart from the licence in these terms, you don’t get any rights in them. Downloaded meditations are for your personal listening in the Fluff app only.

Changes to Fluff

We’re always working to make Fluff better, so we may update the app and change, add or remove content and features from time to time. If we make a change that significantly reduces what you’ve paid for, we’ll let you know and you can cancel your subscription.

Our responsibility to you

We want Fluff to be a calm, reliable space, and we’ll provide it with reasonable care and skill. As a consumer, you have legal rights in relation to digital content that is faulty or not as described, including under the Consumer Rights Act 2015. Nothing in these terms affects those rights. Citizens Advice can tell you more about them.

Within what the law allows:

• We’re responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We’re not responsible for loss or damage that isn’t foreseeable.
• Fluff is for personal use. We’re not responsible for any loss of profit, business or business opportunity.
• We aren’t responsible for delays or problems caused by events outside our reasonable control, such as network failures or problems with Apple’s or Google’s services.
• Our total responsibility to you for any claim relating to Fluff is limited to the amount you paid for your subscription in the 12 months before the claim arose.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can’t legally be limited or excluded, including your statutory rights as a consumer.

Ending this agreement

You can stop using Fluff and delete your account at any time. Remember to cancel any subscription in your App Store or Google Play settings too. We may stop offering Fluff in the future. If we do, we’ll give you reasonable notice where we can.

Changes to these terms

We may update these terms from time to time, for example to reflect changes to the app or the law. We’ll update the “Last updated” date above, and if the changes are significant we’ll let you know in the app before they take effect. If you don’t agree with the new terms, you can stop using Fluff and cancel your subscription.

The legal bits

• These terms are governed by the law of England and Wales, and the courts of England and Wales will deal with any dispute. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live elsewhere, you may also have rights under the laws of the country where you live.
• If any part of these terms is found to be unenforceable, the rest will still apply.
• If we don’t enforce a right straight away, we can still enforce it later.
• You may not transfer your rights under these terms to anyone else. We may transfer ours to another organisation, and we’ll make sure this doesn’t reduce your rights.
• Apart from Apple as described above, no one else has any rights under these terms.
